If you don’t create a prenup, the government will essentially create one for you. In California, the state dictates that both spouses are equal owners in their marriage estate. That means that even if you earn more than your spouse during your marriage, your spouse will be entitled to half of all your earnings if you should get divorced. If your spouse takes out expensive loans while you are married, you’ll be on the hook for half of that too!
